1.3 "Contests" refer to all the league games available on Panga Squadii's web - pangasquadii.co.ke / pangasquadii.com. Panga Squadii reserves the right to add and remove Contests from its Services at its own discretion.

1.4 These Terms and Conditions ("Terms and Conditions") regulate the usage by you ("you", the "User", or the "Player") of the Contests provided on any of Panga Squadii's Services.

1.5 These Terms and Conditions establish the entire agreement between you and Panga Squadii, and no agreements, representations, or warranties, other than those set out herein, shall be of any force or effect.

1.6 These Terms and Conditions constitute a binding agreement between you and Panga Squadii and come into force as soon as you accept the conditions by ticking the "I have read and agreed to the Terms and Conditions and Privacy Policy" box upon registration. By accepting, you signify to Panga Squadii that you have read these Terms and Conditions and accept them. By using any of the Services belonging to, operated by, or licensed to Panga Squadii, you signify that you have read and understood these Terms and Conditions and agree to be bound by them.

1.7 You must read these Terms and Conditions carefully in their entirety before you tick the "I have read and agreed to the Terms and Conditions and Privacy Policy" box. If you do not agree with any provision of these Terms and Conditions, you must not continue with the account registration process.

1.8 These Terms and Conditions may be amended from time to time, as a result of changing operational, legislative, or regulatory requirements. It is your responsibility to ensure that you are aware of all amendments thereto, which will be posted on the Panga Squadii website and communicated via email as and when they occur.

1.9 No addition to, variation, consensual cancellation, or novation of any of the terms set forth herein and no express or implied waiver of any of the rights arising therefrom shall be of any force and effect unless reduced to writing and signed by both parties or their duly authorized representatives.

1.10 No indulgence granted by Panga Squadii in regard to the enforcement of its rights under these Terms and Conditions shall be construed as a waiver of such rights (unless expressly provided for as such in a written document signed by the indulgent Party) nor shall it prevent Panga Squadii from strictly enforcing its rights in the event of a subsequent breach thereof.

1.11 Detailed rules and explanations of Contests are provided in separate links on the Panga Squadii website.

2.1 In order for you to be able to enter any Panga Squadii Contest or game, you must first personally register an account ("User Account") with Panga Squadii.

2.2 You are allowed to have only one User Account. If you attempt to open more than one User Account, the registration process will terminate automatically, and your existing account may be blocked or closed.

2.3 Your account must be registered in your own name and nobody else's.

2.4 A request to open a User Account is made by personally filling out the online registration form and submitting it to Panga Squadii. You must enter all the mandatory information requested into the registration form, in particular, your name and your contact details, including a valid and verified cellular telephone number and email address, and relevant FICA information. All information entered must be complete and accurate.

2.5 Your User Account must be registered in your own given name and surname.

2.6 In certain circumstances, Panga Squadii may request you to provide it with additional information/documents to verify your identity, such as a copy of your official ID card/document and/or proof of residence and/or a "selfie" of you holding one of those documents. If you fail to provide Panga Squadii with the requested documents, or if the information or documents that you provide are found to be false or misleading, the registration process will be terminated and no User Account will be created.

2.7 You may also be required to verify your identity before being allowed to withdraw funds from your User Account.

2.8 For the purposes of these Terms and Conditions, a person under the age of 18 years is referred to as a "minor". Minors are prohibited from registering a User Account on Panga Squadii or playing any Contests. If Panga Squadii is unable to confirm that you are 18 years or older, the registration process will be terminated. In the unlikely event that any minor is proven to have engaged with our Services, the relevant User Account will be closed and any winnings which would have otherwise been payable in respect of Contests won by the minor will be forfeited.

2.9 By entering your accurate date of birth information during registration, you confirm that you are 18 years of age or older.

2.10 It is your sole responsibility to ensure that the information that you provide is true, complete, and correct and that you keep the information up to date. If any of your information changes, please let us know by contacting support pangasquadii@gmail.com.

2.11 If any personal information provided is intentionally incorrect, in an attempt to create an additional User Account, that User will be blocked and become ineligible for prizes or bonuses.

2.12 As part of the registration process, you will have to choose your username and password for login to our Services. It is your sole and exclusive responsibility to ensure that your login details are kept secure. You must not disclose your login details to anyone. Panga Squadii will not be responsible for any use or misuse of your User Account by third parties as a result of the disclosure of your login details to any third party, whether intentional or accidental, direct or indirect, active or passive.

2.13 Panga Squadii reserves the right to refuse to register a User Account or to close your User Account at its sole discretion. However, subject to Clauses 2.8. and 2.11. above, if your User Account is closed, all money legitimately within your User Account will be returned and all contractual obligations already made will be honored.

3.1 Deposits to Panga Squadii are solely for the purpose of entering Panga Squadii Contests.

3.2 You may deposit funds into your Panga Squadii User Account prior to entering a Contest or during the process of entering a Contest.

3.3 You may only deposit funds into your own Panga Squadii User Account, not someone else's.

3.4 Similarly, only you may deposit funds into your Panga Squadii User Account, nobody else can.

3.5 A minimum amount of Ksh 50 may be deposited at a time.

3.6 Any credit cards or similar financial instruments used to deposit funds into your User Account must be valid and lawfully belong to you.

3.7 Panga Squadii is not a financial institution and thus should not be treated as such. No interest will be earned on any amounts deposited into (or won by) your User Account.

3.8 To deposit funds into your User Account, you can use any of the deposit methods specified on the Deposit page. Details regarding processing time and fee structure for the payment methods utilized are available on that page, and may be amended from time to time.

3.9 You may not deposit any funds that originate from any illegal activity or source or which are tainted or associated with any illegal activity.

3.10 In rare circumstances, Panga Squadii may charge certain fees for processing deposits. These fees may change over time. The current fee structure is specified in the relevant pages of the site.

3.11 Panga Squadii reserves the right to use additional procedures and means to verify your identity when effecting deposits into your User Account.

3.12 If as a result of any error, Panga Squadii credits your User Account with funds that do not belong to you, whether due to human or technical error or otherwise, the amount in question will remain property of Panga Squadii. The amount will be deducted from your User Account as soon as Panga Squadii becomes aware of the mistake. If you withdraw funds that do not belong to you, without prejudice to other remedies and actions that may be available at law or otherwise, the amount paid by mistake will constitute a debt owed by you to Panga Squadii. If you notice that your User Account has been incorrectly credited, you are obliged to inform Panga Squadii of this immediately via pangasquadii@gmail.com.

3.13 All information related to funds deposited can be found under "Wallet".

4.1 You may withdraw the entire amount of your balance from your Panga Squadii Wallet, except for any "non-withdraw-able" funds, which will be clearly labelled as such.

4.2 A minimum amount of Ksh 50 may be withdrawn at a time. Some withdrawal methods may incur certain fees for processing withdrawals. The current fee structure is specified in the relevant pages of the site.

4.3 Panga Squadii does not accept requests for withdrawals made by telephone or email. Requests for withdrawals can only be made via the Panga Squadii website.

4.4 Withdrawals shall only be paid into the nominated account once Panga Squadii has successfully confirmed that such account is a valid account held by you in your name.

4.5 Details regarding processing time and fee structures for withdrawals in respect to the method utilized are available on the "Wallet" page and may be amended from time to time.

4.6 Subject to any verification procedures which may be required at any time, requests for withdrawals will be processed as swiftly as possible, but in any event within a maximum of 5 business days.

4.7 Panga Squadii reserves the right to perform enhanced due diligence in respect to withdrawals of funds not used for entering Contests and to review your deposit and withdrawal behaviour and use of our Services for unusual or irregular patterns.

Payouts in the pangasquadii.co.ke fantasy football leagues are awarded exclusively to the top 2% of participating managers each gameweek, based on their performance rankings. For instance, in a league with 1,000 managers, only the top 20 managers will receive the designated cash prizes. Eligibility for payouts requires active participation and compliance with all league rules.

6.1 An inactive account is an account that has a positive Wallet balance but has not been accessed for 18 months.

6.2 A dormant account is an account that has a positive Wallet balance but has not been accessed for 36 months.

6.3 In the case of inactive accounts, Panga Squadii reserves the right to charge a monthly administrative fee of Ksh 10 on your account, for as long as the balance is positive, and your account stays inactive.

6.4 Any non-withdraw-able balances, such as those claimed through referrals or promotions, will expire after 18 months.

6.5 Holders of User Accounts who wish to recover funds held in a closed, locked or excluded account, are advised to contact pangasquadii@gmail.com.

7.1 If you wish to close your account, you may do so at any time by emailing pangasquadii@gmail.com.

7.2 Panga Squadii will return to you all withdraw-able funds from your User Account subject to the deduction of relevant withdrawal charges and compliance with these Terms and Conditions.

7.3 Panga Squadii reserves the right to terminate your User Account and to refund to you the withdraw-able Wallet balance, subject to the deduction of relevant withdrawal charges and compliance with these Terms and Conditions, at its absolute discretion and without any obligation to provide a reason or give prior notice.

8.1 You are over 18 years of age.

8.2 You are solely responsible for compliance with any tax obligation in respect of any winnings and withdrawals from Panga Squadii.

8.3 You participate in the Contests knowing that Panga Squadii is a game of skill not a game of chance.

8.4 All information that you provide to Panga Squadii during the term of this agreement shall be true, complete, and correct, and you shall immediately notify Panga Squadii of any change in such information by emailing pangasquadii@gmail.com.

8.5 All funds that you deposit into your User Account are not tainted by any illegality and, in particular, do not originate from any illegal activity or source.

8.6 You understand that you take the risk of losing any and all money deposited into your User Account as a result of participating in any of the Contests.

9.1 You may participate in any public paid Contest only if you have a sufficient balance in your Panga Squadii Wallet required to enter the Contest.

9.2 In order to make the game more competitive for users with single entries, some contests may have soft limits on the number of times you may enter, after which point a service fee may be payable to continue entering further teams. This service fee is not added to the prize pool.

9.3 Once you have entered into a Contest and an amount has been debited from your Wallet, you will not be able to cancel your entry for that Contest.

9.4 You will be able to make as many changes to your entered team (including formation, player selections, captaincy and vice-captaincy) as you wish up until the Contest deadline, which will be clearly displayed on the Contest page. Generally, Contest deadlines are 90-minutes before the start of the first event in the Contest.

9.5 The amount of winnings (either Ksh, non-withdraw-able Ksh, or Sponsored Prizes) for each Contest will be confirmed at the Contest deadline, and available for all Players to see.

9.6 The number of winning positions in a Contest is determined prior to a Contest deadline, but can change regularly at Panga Squadii's discretion depending on number of users participating in a Contest. Winning positions will be available for all Players to see prior to the start of a Contest.

9.7 Contest winners will be notified via email and/or SMS and any Ksh pool prizes (withdraw-able and/or non-withdraw-able) will be credited to their User's Wallet.

9.8 A history of your previous Contest entries will be visible on your Wallet page.

9.9 In the event of a tie in a Contest, the tied Players will split or share the allocated prize.

9.10 Payment of any taxes, fees, charges and levies that may apply to your winnings under any applicable laws shall be your sole responsibility.

9.11 Contest Cancellations and refunds may be given in case of exceptional circumstances, such as postponed or cancelled real-life events, solely at the discretion of Panga Squadii.

9.12 70% of every entry fee received in each contest will be added to the prize pool, except in free-to-play contests.

10.1 Player awareness of any suspicious activity relating to any of the Contests provided on the sites, must be reported to Panga Squadii immediately.

10.2 For the purposes of the creation of a User Account, and for the purposes of any transaction, Panga Squadii may undertake any such verification checks as may be required by law or by third parties (including, but not limited to, regulatory bodies) to confirm the identity of the customer and the origin of the money used on our Services.

10.3 Panga Squadii will report any suspicious transactions to the relevant competent authorities in Kenya.

10.4 Panga Squadii reserves the right to block, close or suspend a User Account and withhold funds if requested to do so in accordance with any applicable legislation pertaining to money laundering or the financing of terrorism.

11.1 Panga Squadii owns the rights to all software, user interfaces and graphic features made available to its customers. These are protected by Copyright laws and you may only use the sites for your personal use in accordance with these Terms and Conditions and the applicable laws.

11.2 You will need prior approval from Panga Squadii to display, reproduce or use trademarks, service marks, trade names or/and accompanying logos used or reflected on the site.

11.3 Other products and service names displayed or referred to on Panga Squadii may be trademarks and service marks owned by other companies. These may not be displayed, reproduced or used without the written consent of the owners thereof.

11.4 Animations, avatars, images, background images, other graphics, photographs, video and audio clips, button icons, streaming data, download-able materials, data compilations and software, accessible from any website licensed, operated or controlled by Panga Squadii are the intellectual property of Panga Squadii or any party responsible for providing such materials.

11.5 The materials may not be copied, distributed, republished, modified, uploaded, posted, or transmitted in any way without the prior written consent of Panga Squadii.

12.1 If you have a complaint you may contact our support team at pangasquadii@gmail.com.

12.2 Panga Squadii will use best efforts to resolve a reported matter promptly. If you disagree with Panga Squadii's final decision in respect of your claim and/or dispute and would like to dispute it, then you may send your written submission along with the final decision of Panga Squadii to the National Consumer Commission.

13.1 You enter the Panga Squadii website and participate in the Contests at your own risk. The Websites and the Contests are provided without any warranty whatsoever, whether express or implied.

13.2 Without prejudice to the generality of the preceding provision, Panga Squadii, its directors, employees, partners, service providers: - do not warrant that its Services are fit for their purpose; - do not warrant that its Services are free from errors; - do not warrant that its Services and/or the Contests will be accessible without interruptions; - shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to your use of the Services or your participation in the Contests.

13.3 You hereby agree to fully indemnify and hold harmless Panga Squadii, their directors, employees, partners, and service providers for any cost, expense, loss, damages, claims and liabilities howsoever caused that may arise in relation to your use of the software or participation in the Contests to the fullest extent permissible in law.

14.1 If you breach any provision of these Terms and Conditions or Panga Squadii has reasonable grounds to suspect that you have breached them, Panga Squadii reserves the right to suspend or close your User Account, to withhold any money in your User Account and to apply such funds for the recovery of any monies lawfully due by you to Panga Squadii.

14.2 Panga Squadii reserves the right to freeze or terminate your User Account if there are reasonable grounds to suspect that you (i) are in breach of these Terms and Conditions; (ii) have engaged or are engaging in illegal or fraudulent activities when using any of our Services or the referral program or (iii) have engaged in or are engaging in conduct which is otherwise detrimental to its business.

14.3 You acknowledge that Panga Squadii shall be the final decision-maker regarding whether you have violated these Terms and Conditions for the purposes of determining whether your User Account should be suspended or permanently closed.

15.1 If any provision of these Terms and Conditions is held to be illegal or unenforceable, such provision shall be severed from these Terms and Conditions and all other provisions shall remain in force unaffected by such severance.

16.1 This website is governed by the laws of Kenya and Panga Squadii chooses as its domicile citation and execution for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

16.2 The offering on this website is available to Kenyan clients only.

16.3 Panga Squadii may, in its sole discretion, change this agreement or any part thereof at any time without notice.
